Terms and Conditions

1. Operator and scope

These Terms and Conditions apply to all business relationships between Holger Sadek, BSc (sole proprietor, Austria) – hereinafter “yul.io” – and the users of the platform.

yul.io provides a web-based platform for collaboratively creating video gifts.

2. Definitions

User:

any person using yul.io.

Owner:

a user who creates and manages an event.

Participant:

a person who uploads content via a tokenized link.

Recipient:

the person for whom the video gift is intended.

3. Services

yul.io enables, in particular:

Processing is automated and forms an essential part of the service.

• creation and management of video events
• uploading videos and images via tokenized links
• organizing and editing content
• technical processing, e.g. rotation, trimming and audio adjustment
• rendering a final video compilation

4. Use and access

Owners access the service through a user account, and participants access the service through tokenized links.

Any sharing of access links or token links is at the user’s own risk. The holder of a valid token is deemed authorized.

5. Content and responsibility

Users may upload content such as videos, images and text.

The user warrants that they hold all necessary rights to the uploaded content and that no third-party rights are infringed.

yul.io is not responsible for user content.

yul.io reserves the right to delete content at any time, in particular in the event of legal violations, misuse or violations of these Terms and Conditions.

6. Rights of use

The user grants yul.io a non-exclusive right, limited to the term of the contractual relationship, to store, technically process, edit and use content for rendering to the extent necessary to provide the service.

7. Community features

Optional community features such as comments and reactions may be enabled within an event.

Moderation is carried out by the owner. yul.io has no obligation to monitor content.

8. Prices and payment

yul.io offers both free and paid services.

Paid services relate in particular to exporting the final video compilation in higher quality.

Activation is only granted after successful rendering, confirmation by the user and successful payment.

• Payments are one-time payments and not subscriptions

9. Payment processing

Payment processing is handled by external payment service providers, in particular Stripe.

yul.io does not store full payment details.

The contract regarding payment processing is concluded exclusively between the user and the respective payment service provider.

10. Data processing

yul.io processes data exclusively for the purpose of providing the service.

Processing includes in particular the storage of content, its technical processing and rendering.

Processing generally takes place within the EU or EEA. Technical service providers may be engaged to provide the service.

11. Storage period and deletion

Content is stored for at least 6 months.

Users may delete content, events and accounts themselves at any time.

yul.io is not intended to serve as a permanent archiving platform.

12. Liability

yul.io is not liable for user content, infringements committed by users, loss of data or misuse of tokens.

yul.io is liable only for damages caused by intent or gross negligence.

Liability for indirect damages, loss of profit or consequential damages is excluded to the extent permitted by law.

13. Availability

yul.io strives for high availability but does not provide any guarantee.

Rendering processes are automated. There is no entitlement to specific processing times or results.

14. Minimum age

Use of yul.io requires the legal capacity to enter into binding contracts.

15. Reference use

Any use of user content, names or identifiers for reference purposes requires the user’s express consent.

16. Termination

Users may delete their account at any time. Deletion ends the contractual relationship.

17. Changes to these Terms and Conditions

yul.io reserves the right to amend these Terms and Conditions with effect for the future.

18. Applicable law and place of jurisdiction

Austrian law applies.

The place of jurisdiction is Vienna, to the extent permitted by law.

19. Severability clause

Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
